TERMS AND CONDITIONS

Ethnic & Boheme wishes to ensure that your needs are met in every way. To allow a smooth transaction in the supplying of items for your function, we wish to highlight the following conditions.

Ordering, Acceptance and Payment

The Hirer must pay a 25% non-refundable deposit within seven (7) working days of order confirmation to authorise Ethnic & Boheme to proceed with the booking/order. This 25% deposit is deemed confirmation of an order. Full payment of the order must be paid to Ethnic & Boheme seven (3) working days prior to the event.

Ethnic & Boheme is not obliged to deliver possession of the equipment to the hirer until funds given in payment are cleared. All confirmations are subject to availability at the time confirmation is received by Ethnic & Boheme. Late Confirmations will incur additional charges; Bank Transfers, Credit Card or Cash are our preferred methods of payment. All Credit Cards attract a fee of 2.5% Prices are subject to change without notice.

Weather

Ethnic & Boheme maintains a stringent weather policy and will refrain from setting up outdoors in the event of predicted rain during the scheduled time or if the ground is excessively wet due to inclement weather leading up to the event. Additionally, extreme heat and hazardous winds are conditions under which Ethnic & Boheme reserves the right to decline outdoor work. To mitigate potential issues arising from poor weather conditions, clients are strongly advised to have a backup venue in place or make necessary provisions.

It is essential for clients to be aware that all cancellations, regardless of the reason, are subject to the stipulated cancellation policy. Recognizing the unpredictability of weather, if one week before the event the weather is unfavorable, clients have the option to reschedule without incurring any additional costs, provided the change is agreed upon by both parties and communicated to Ethnic & Boheme.

Bond

If requested by Ethnic & Boheme, the Hirer must pay (in addition to the deposit) a bond equivalent to 30% of the total cost. Ethnic & Boheme may apply so much of the bond as is necessary to compensate Ethnic & Boheme for any breach, by the hirer, of the contract, or any damage or loss sustained in respect of the equipment. The balance, if any, is refundable to the Hirer.

Special Purpose Costs

If items are required to be specially produced for the event, Ethnic & Boheme reserves the right to collect partial or full payment of these special hire items prior to commencement of production.

Cancellations

Non-refundable: 50 % of the order cost, plus any applicable special purpose costs for cancellation up to 7 working days prior to the event Non-refundable: 100% of the order cost for cancellation less than 7 working days prior to the event

Variations & Amendments

Ethnic & Boheme provides an obligation free design and quotation service for the initial consultation at no cost to the hirer. Also, the first design and quotation cost variation requested by the hirer to the confirmed order is free of charge. Thereafter, in addition to the costs outlined above, Ethnic & Boheme reserves the right to charge the Hirer an additional design and quotation service fee of $150.00 (exclusive of GST) for the amendment to each order unless the following applies:

In the event that additional design and quotation services are requested by the hirer Seven (7) working days or less from the event then a 10% surcharge of total order will apply
In the event that additional design and quotation services are requested by the hirer Three (3) working days or less from the event then a 15% surcharge of total order will apply

Damage & Loss

The Hirer shall be responsible for any loss or damage to any of the hire items arising from the time the Hirer has taken delivery of the hire items until the Hirer returns the hire items to Ethnic & Boheme. The Hirer agrees to pay full replacement costs for any equipment lost, stolen or considered by Ethnic & Boheme as being irreparably damaged. Such payment shall be made by the Hirer within seven (7) working days of such loss or damage coming to the attention of Ethnic & Boheme.

The Hirer Agrees

Hired items cannot be sub-hired to other parties without the express permission of Ethnic & Boheme.
To be responsible for all loss or damage caused to any person or property in relation to the hired equipment or the use there of . The Hirer shall be liable to effect public risk insurance in relation to the equipment for the duration of the period of hire.

Access to Venue

Access to the loading dock, goods lift and venue space, must be available and safe, at the times agreed, between the Hirer and Ethnic & Boheme for all bump in and out requirements. Any delays, blockages or unsafe working environments will incur an additional fee deemed appropriate by Ethnic & Boheme.

The Hirer acknowledges that copyright in all designs, drawings, proposals and other material produced by Ethnic & Boheme or any of its consultants in connection with this Contract remains the property of Ethnic & Boheme (or its consultants as the case may be). The Hirer must not infringe copyright in respect of that material.
